These Terms and Conditions ("Terms") govern your use of the website and services provided by Miranda Bassagi Photography, operating under Miranda's Graphics LLC ("we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms.

We are committed to protecting your privacy. We collect personal information, such as your name, email address, phone number, and project details, solely for the purpose of providing our photography services, communicating with you, and processing payments. We do not sell, rent, or share your personal information with third parties for their marketing purposes. We implement reasonable security measures to protect your data, but no method of transmission over the internet or electronic storage is 100% secure. You acknowledge and agree that we cannot guarantee the absolute security of your information.
Pricing and Payments
All pricing for photography services is clearly outlined on our website or provided to you in a custom quote. Prices are subject to change without prior notice, but any agreed-upon pricing for a booked service will be honored. A non-refundable retainer fee may be required to secure your booking, with the remaining balance due as per your service agreement. Payments can be made via accepted methods as specified on our website or invoice. In the event of late payments, a late fee may be applied.
Fees and Cancellations
Retainer Fees: Retainer fees are non-refundable, as they secure your booking and compensate us for lost opportunities.
Cancellations: If you need to cancel a booked session, please notify us as soon as possible.
For cancellations made 7 days prior to the session: Any payments made beyond the non-refundable retainer may be eligible for a partial refund or credit towards future services, at our discretion. For cancellations made within 72 hours of the session: All payments are non-refundable.
Rescheduling: We understand that unforeseen circumstances can arise. We will do our best to accommodate rescheduling requests, subject to our availability. Rescheduling may incur an additional administrative fee.
Dissatisfaction with Images: If you are not satisfied with your images, please contact us within 48 hours of receiving them to discuss your concerns. Refunds or re-shoots are provided solely at our discretion and only in cases where we determine there was a significant technical issue with the photography that was within our control.
Copyright
All images, both raw and edited, created by Miranda Bassagi Photography remain the exclusive copyright property of Miranda's Graphics LLC. When you purchase images or services, you are purchasing a license to use the images for personal or agreed-upon commercial purposes, not the copyright itself. You may not reproduce, distribute, publicly display, or create derivative works from the images without our explicit written permission. Unauthorized use of our images is a violation of copyright law and will be subject to legal action.
Non-Release of Unedited Images
Our Unwavering Commitment to Quality and Artistic Integrity
We maintain a strict policy against releasing unedited or raw image files to clients. This isn't just a preference; it's a cornerstone of our artistic vision, our brand identity, and the quality of the final product we deliver. Every image you receive from us has been meticulously edited, a process that reflects our unique style and dedication to excellence. Providing unedited files would directly compromise our artistic integrity and the high standards we've worked so hard to establish. Therefore, under no circumstances will unedited or raw image files be provided.
Post-Editing Adjustments and Additional Selections
Once your photos have undergone our comprehensive editing process, they are considered final and cannot be changed or swapped for other images from your session. Our editing workflow is precise and deliberate, ensuring each selected image meets our stringent quality benchmarks. Should you decide you'd like additional photos from your session to be edited beyond what was initially agreed upon, we're happy to accommodate your request. Please note that additional fees will apply for these extra edits, as they require dedicated time and resources from our team.
Client Responsibilities
You agree to:
- Provide accurate and complete information when booking and communicating with us. This helps us tailor our services to your needs.
- Arrive on time for your scheduled session. Punctuality ensures we have adequate time to capture your desired images and keeps our schedule running smoothly.
- Communicate any specific requests or concerns prior to your session. The more information we have beforehand, the better we can prepare to meet your expectations.
- Adhere to any instructions or guidelines provided by the photographer during the session. These guidelines are in place to ensure your safety, the quality of the photographs, and the efficiency of the session.
- Promptly review and approve any proofs or galleries provided within the specified timeframe. This helps keep your project on schedule.
- Make timely payments as outlined in your agreement.
- Be responsible for the conduct of any accompanying guests during the session. We want everyone to have a pleasant experience.
Limitation of Liability
In no event shall Miranda's Graphics LLC, its employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in any way connected with your use of our website or services, whether based on contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or our services shall be exclusively resolved in the state or federal courts located in Houston, Texas.
